The State of Arizona recently enacted legislation adding another stricter level to DUI charges: Extreme DUI. A person is charged with extreme DUI when their blood alcohol content is greater then .15 within two hours of driving. Accordingly, they are subject to much harsher fines and penalties than someone who is arrested for a DUI at a lower blood alcohol concentration. If you have been arrested and convicted of extreme DUI you are subject to the following:

• 30 days in jail, but 20 may be suspended. Everyone convicted of Extreme DUI in Arizona must spend 10 days in jail.
• Fines, fees and assessments of at least $2700, and usually more for jail costs.
• A substance abuse evaluation and any education or counseling that is recommended as a result of the evaluation.
• Installation of an ignition interlock device on your vehicle for one year; Please note, these devices may cost in excess of $1,000 for the year
• Community service

For an Extreme DUI conviction with a prior DUI conviction within the past 84 months (7 years), the current mandatory minimum sentence must include:

• 120 days in jail, but 60 days may be suspended.
• Fines, fees and assessments of at least $3750, and usually more for jail costs.
• A substance abuse evaluation and any education or counseling that is recommended as a result of the evaluation.
• A one-year license revocation, with the installation of a certified ignition interlock device on a vehicle for the first year after the license is reinstated.
